These terms explain what PlanCheck is, how you may use it, and what applies when you create an account or buy from us. Please read them before using the service.

1. What PlanCheck is

PlanCheck is a property planning information service for homeowners in England. It is designed to help you understand whether your home improvement project may require planning permission, and to provide general guidance on the planning considerations that may apply. PlanCheck is operated by K Henry, a qualified town planner based in the United Kingdom.

2. The automated planning checker

The automated planning checker generates an initial assessment based on the information you provide and standard planning rules applicable in England. It is an information tool only. It is not professional planning advice and it cannot be relied upon as a substitute for a formal decision by a Local Planning Authority or a Lawful Development Certificate. Results reflect the answers you give and the rules in force at the time of the assessment. We cannot accept responsibility for information that is entered incorrectly or incompletely.

3. Ask PlanCheck

Ask PlanCheck is an AI assisted tool that allows you to ask general planning questions. Responses are generated using AI technology and are intended to provide general information only. They do not constitute professional planning advice and should not be relied upon as such. Always seek formal professional advice before starting any building work.

4. Professional review service

The professional review is a written planning opinion prepared by a qualified planning professional. It is based on the information you provide and reflects reasoned professional judgement at the time it is prepared.

The review is designed to help you better understand your position before committing further time and money to your project. It does not constitute a statutory decision. Only a formal decision issued by the Local Planning Authority, or a Lawful Development Certificate, can provide definitive legal confirmation that a development is lawful.

We aim to deliver your review within 3 to 5 working days of receiving payment and all required information. Timescales may vary during periods of high demand.

5. Property Hub accounts

A Property Hub is a free account that lets you save your property, view a monthly summary of nearby planning activity, and monitor planning applications near your home. We use a magic sign in link sent to your email address rather than a password, so it is important to keep access to your email account secure. You are responsible for activity that takes place under your account. You can delete your Property Hub and the information held against it at any time from within your account, or by contacting us.

6. Premium subscriptions and passes

PlanCheck offers paid options that unlock additional features, including a monthly Premium subscription and a fixed length access pass. The features included and the price are shown clearly at checkout before you pay.

The Premium subscription renews automatically at the end of each billing period using the payment method you provided, until you cancel. You can cancel at any time, and your Premium access continues until the end of the period you have already paid for. A fixed length pass gives you access for the stated period and does not renew automatically.

We may change subscription prices or features from time to time. If we do, we will give you reasonable notice, and any new price will only apply from your next billing period.

7. Payments, refunds and cancellation

Payments are processed securely by Stripe. All prices are shown in pounds sterling and include any applicable tax. We do not see or store your card details.

If you are a consumer, you normally have a legal right to cancel a purchase of digital services within 14 days. Because our digital services and reviews begin as soon as you ask us to start, you agree that we may begin straight away, and you accept that you lose this right to cancel once the service has been fully performed. Where a service has only been partly performed when you cancel, you may be charged for the part already provided.

Because professional reviews involve the allocation of professional time once you submit your request, refunds are not available once work on your review has begun. If you have a concern about any purchase, please contact us and we will do our best to resolve it.

You can cancel a Premium subscription at any time from your account or by contacting us. Cancelling stops future payments, and your access continues until the end of the period you have already paid for. We do not provide partial refunds for the remainder of a billing period.

8. Limitation of liability

To the fullest extent permitted by law, PlanCheck accepts no liability for any loss or damage arising from reliance on any automated assessment or Ask PlanCheck response.

In respect of the professional review service, our liability is limited to the fee paid for that review. We are not liable for any indirect or consequential loss including loss of profit, loss of opportunity, or the cost of building works commenced in reliance on a review.

Nothing in these terms limits our liability for death or personal injury caused by negligence, fraud, or any other matter that cannot be excluded by law.

9. Intellectual property

All content on PlanCheck including the planning checker, written reviews, and supporting materials is the intellectual property of PlanCheck. You may not reproduce, distribute, or commercially exploit any part of it without our written permission.

10. Acceptable use

You agree to use PlanCheck only for lawful purposes and in a manner that does not infringe the rights of others. You must not attempt to access any part of the service you are not authorised to use, or use the service to submit false or misleading information.

11. Third party and public data

PlanCheck draws on information from third party and public sources, including HomeData, planning.data.gov.uk and Historic England, to show nearby planning activity and possible constraints. We present this information in good faith, but we do not control these sources and cannot guarantee that it is complete, current or free from error. You should always confirm important details directly with the relevant Local Planning Authority.

12. Affiliate links and partners

PlanCheck may include links to third party products or services, and may take part in affiliate arrangements where we receive a commission if you sign up or buy through one of our links. This never affects the price you pay, and it does not influence the planning guidance we give, which is based only on the information you provide and the rules that apply.

13. Changes to the service

We reserve the right to modify or discontinue any part of PlanCheck at any time. We will endeavour to give reasonable notice of significant changes where possible.

14. Governing law

These terms are governed by the laws of England and Wales. Any disputes arising under them will be subject to the exclusive jurisdiction of the courts of England and Wales.
